Lawyer’s Traffic Ticket Guide for Westfield Village Court
The Village of Westfield covers nearly 4 square miles in the Town of Westfield, and has a population of 3,481 (2010 U.S Census). The village, known as the “Grape Juice Capital of the World”, is situated along Interstate 90, U.S. Route 20, and New York State Routes 5 and 394.
These highways cover many open stretches of road where a driver can easily lose sight of the speed limit; finding themselves facing a hefty speeding ticket.
Further complicating things are the frequently changing topography with the rolling hills and rapidly changing speed limits. Unless a driver keeps an uber vigilant eye on their speedometer, they could be prone to being tagged with a costly traffic summons.
Traffic tickets are no laughing matter. No one wants to receive a speeding ticket or cell phone violation. Not only are they annoying, but they are also costly.

Court Information and TipsCourt Address:Westfield Village Court
23 Elm Street
Westfield, NY 14787
The village court is in session, except for holidays:
- Every Thursday at 7:30 p.m. for all traffic violations,
- Every 3rd Thursday of each month at 9:30 a.m. for criminal cases.
Tip: It is always a good policy to come to court prepared. Having the court notice in court is advisable. It will help the court ascertain the most important information about your case quickly.
Lay of the Land: Once you enter the courtroom, you will be greeted by a court officer that will lead you through a metal detector. As you enter the court, there will be two small seating areas to the left and right. There will be seating for attorneys to the front right of the court. The court clerk will be seated to the left. It is important to check-in with the court clerk. Failure to check in may result in a default being held against you.
Pleading Guilty: Pleading guilty to a speeding ticket can have long-term financial consequences that may cost drivers hundreds in fines, penalties, and insurance increases. A study by a leading insurance company concluded that the national average increase for a speeding conviction is 11% - 15%. In other words, this is the median increase. Some drivers will not receive an increase while others will receive a much larger increase.
Burden of Proof: Unlike traffic matters heard in the Traffic Violations Bureau of NYC and other parts of the State, tickets in Town and Village Courts must meet the standard of proof beyond a reasonable doubt. Many legal scholars have debated exactly what is meant by proof beyond a reasonable doubt. However, everyone agrees that it is the highest standard of proof in the US judicial system.

Points will affect a driver’s privilege to drive for 18 months from the date in which the ticket was issued. In other words, the points do not run from the date of the conviction. They run from the moment the officer issued the summons.
In terms of quantifiable dollars and cents, conviction to an 86/65 mph zone can result in a fine of almost $400.00, an additional $300.00 fine payable to the department of motor vehicles, 6 points on a driving record, and significant insurance increase.
Failure to pay a fine could result in many adverse consequences. The most common penalty is suspended a driver’s privilege to drive. If a driving is stopped for driving with a suspended license, the police officer has the authority to place the driver under arrest and charge the drive with a crime.
