How do Points Affect a License?

New York State has a traffic point system that can affect a motorist’s privilege to drive.  In general, in any given 18 month period, a motorist is allowed up to 10 point to be deducted from their license before their privilege to drive is suspended.  

There are many other reasons why a person’s privilege to drive can be suspended or revoked, but this article is merely discussing a broad view of the traffic point system. New York has assigned a varying number of points for many different violations.  In other words, the State does not have a flat penalty for points concerning traffic violations.

If you are assessed points on your license, the points are not permanent. For the purposes of a suspension, points will stay on your license for an 18 month period from the date of issuance.

If you obtain a copy of your driving record, a conviction may be visible for more than 18 months even though the points are no longer being held against you.

The most common traffic ticket encountered by this law firm is a speeding ticket.  Many out of state drivers will be assessed points in this New York State and they are unsure whether or not the points will transfer back to their home state.  Most states have reciprocity and there each state may implement the reciprocity in different ways.
