The Wawarsing Justice Court is open every Monday through Thursday from 8:00 a.m. to 4:00 p.m. and on Friday from 7:00 a.m. to 3:00 p.m. Traffic Court is in session every Wednesday beginning at 1:30 p.m.; Criminal Court is held on Friday at 8:30 a.m.
If you received a ticket by a New York State Police Officer, you will have an opportunity to meet with the Town Prosecutor prior to trial. At this meeting, you may have the opportunity to reach a settlement of your charges. If you are unable to resolve your matter, your case may be adjourned for a date in which the officer can appear in court and testify.
Sign-In: It is very important that you notify the court clerk that you are present for your court date. Failure to notify the court clerk may result in your case not being called.
Junior License: If you have been issued a speeding ticket while possessing a Junior License, you may be required to appear in court regardless of your plea. A driver with a junior license should be very careful with resolving their speeding violation. This is because the Department of Motor Vehicles has more stringent guidelines for young drivers.
Burden of Proof: Unlike traffic matters heard in the Traffic Violations Bureau of NYC and other parts of the State, tickets in Town and Village Courts must meet the standard of proof beyond a reasonable doubt. Many legal scholars have debated exactly what is meant by proof beyond a reasonable doubt. However, everyone agrees that it is the highest standard of proof in the US judicial system.
