What to Expect in CourtIf you’re going to court for the first time, it can seem quite overwhelming. So here are a few pointers and tips to help you.
Tip: It is very important that you are not late to your court date. It is always a good policy to arrive earlier than the time given to you. If you arrive late, there is a chance that your case could have been called in your absence.
What to Bring: You should bring your court notice and driving record. Your court notice will help a court personnel direct you if you are displaced. Your driving record, if it is clean, can help mitigate your situation.
You should also bring in enough money to pay any court fines, if your case is resolved at the first court appearance.
Dress Code: Although there is no official dress code; we highly recommend all litigants wear formal attire when going to court. Many judges frown upon those individuals who wear shorts, open-toed sandals, or other similar items.
If Found Guilty: If you are found guilty of speeding, there are many different ways in which it may affect you. This can include but is not limited to fines payable to the court, penalties payable to the Department of Motor Vehicles, insurance increases, and incarceration.
Points, Fines and Additional InformationIn New York State, speeding tickets range from 3-11 points. Please look at the following chart to see the break up of points with reference to the speed.
Speeding | Points |
01 to 10 mph over the limit | 3 |
11 to 20 | 4 |
21 to 30 | 6 |
31 to 40 | 8 |
More than 40 | 11 |
Important: Points will affect a driver’s privilege to drive for 18 months from the date in which the ticket was issued. In other words, the points do not run from the date of the conviction. They run from the moment the officer issued the summons.
Suspension: If you receive 11 points, your license will be suspended. Driving with a suspended license is a crime. If you are pulled over, the officer can arrest you and impound your car.
A conviction to an 86/65 mph zone can result in a fine of almost $400.00, an additional $300.00 fine payable to the department of motor vehicles, 6 points on a driving record, and significant insurance increase.
Note, insurance costs can vary for two very similar situated drivers. A speeding conviction is not the only factor taken under consideration by insurance companies. They will also examine things such as a driver’s age, type of car driven, and car accident history.
