AUO 2nd Degree (VTL 511.2) Aggravated Unlicensed Operation in the 2nd Degree

VTL §511.2 If you are caught driving while having three or more suspensions or revocations, originating from three or more separate dates, you can be charged with this crime.  This charge is a higher misdemeanor charge than the AUO 3rd. As such, the possible punishment is more serious. Should you be convicted of this crime, you could be sentenced to hundreds of dollars in fines and a minimum sentence of seven days jail or three years probation.

There are other circumstances wherein you can also be found guilty of under VTL 511.2. They include but are not limited to the following: if you commit an AUO 3rd and

• had previously been convicted of an offense that consists of or includes the elements comprising AUO 3rd within the preceding last 18 months; or
• your license was suspended or revoked because you refused to take a chemical test pursuant to a DWI charge; or
• your license was suspended or revoked because of a prior DWI conviction.
